If you are seeking to instruct Jobs On Board Ltd for the provision of talent acquisition services, our standard terms and conditions shall apply (copy available upon request) also a copy of our terms of business will be sent to you before we secure any candidates (clients only not applicable to candidates).
Use of the Jobs On Board Website
We operate the Jobs On Board website to assist you in understanding Jobs On Board services and in communicating with us.

Registration
In order to access to receive job alerts you must register with Jobs On Board via sending us your resume and cover letter. If you register, you must ensure that the details provided by you on registration or at any time are correct and complete.
You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.
Consent
In using the Jobs On Board website and submitting your Curriculum Vitae and cover letter to this global recruiter in accordance with the GDPR (General Data Protection Regulation) and other data protection laws you are giving your full consent for us to use the contents you have provided to secure employment for you.
Right to suspend or cancel your registration
We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
You can cancel your registration at any time by emailing a request to info@jobsonboardglobal.com The suspension or cancellation of your registration and your right to use shall not affect either party's statutory rights or liabilities.
Blacklisting
Jobs On Board Ltd guarantees an efficient, adequate, and accountable system that protects and promotes a candidate’s employment rights. As such, Jobs On Board Ltd will never refuse its services to a candidate for a reason related to a ‘prohibited list’, otherwise known as a blacklist. Additionally, Jobs On Board Ltd will not create, supply, sell, or use a blacklist that could prevent qualified candidates from obtaining employment
Disclaimer
Whilst Jobs On Board Ltd uses reasonable care in compiling and presenting the content found on the Jobs On Board website, it is provided purely for information and you should seek further guidance and make independent inquiries before relying upon it. If Jobs On Board Ltd is informed of any inaccuracies in the material on the Jobs On Board website we will attempt to correct the inaccuracies as soon as we reasonably can.
If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer to the extent that they are a foreseeable consequence to both of us. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

Complaints
The Jobs On Board Ltd welcomes and encourages feedback of all kinds from its clients. Complaints relating to any aspect of the services provided should be made in accordance with the Jobs On Board Ltd, please forward any complaints you have to info@jobsonboardglobal.com, and your complaint will be dealt with as soon as we reasonably can.
If a candidate feels that a complaint has not been handled fairly and/or in a timely fashion by Jobs On Board Ltd, they may contact the NZ Maritime Coastguard Agency via mlc@maritimenz.govt.nz.
Availability of the Jobs On Board website
We cannot guarantee that the service will be fault-free. If a fault occurs in the service, you should report it info@jobsonboardglobal.com and we will attempt to correct the fault as soon as we reasonably can. If Jobs On Board Ltd is informed of any inaccuracies in the material on the Jobs On Board website we will attempt to correct the inaccuracies as soon as we reasonably can.
Your access to the Jobs On Board website may be occasionally restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
Applications
When applying for a vacancy, the candidate must ensure that they:
· Have read the complete details of the vacancy;
· Understand the requirements of the vacancy;
· Meet the requirements of the vacancy; and
· Possess any requisite experience, qualifications, and licenses required by the vacancy.
· Jobs On Board shall forward the candidate’s details to clients for the purpose of the relevant vacancy only. In the event that the candidate wishes to apply for multiple vacancies to the same client, they must submit separate applications for each vacancy.
· Jobs On Board reserves the right and the discretion to decline to forward applications to its clients if it considers them to be in breach of these Terms and Conditions.
· The Candidate agrees to advise Jobs On Board if they have an application pending, or have previously applied for the same vacancy, regardless of whether the application was submitted directly to the respective cruise line, or another hiring/manning agent. In such cases, Jobs On Board may not be able to progress the application.
· Through the verification process for placement, all seafarers introduced to respective employers are confirmed to hold all qualified documents necessary for the job applied for. Jobs On Board only partners with respectable cruise lines that have their DMLC2 this ensures that the seafarer's employment agreements are in accordance with applicable laws and regulations and any collective bargaining agreement that forms part of the employment agreement, this will include but is not limited to repatriating the seafarer if stranded in a foreign port.
· In the assurance the seafarer will have no monetary loss in the recruitment process, the only monetary outlay to the seafarer shall be after the verification process has been completed and a job offer has been made with the normal conditions attached i.e completing and passing the required seafarers medical, STCW certification, Crowd & Crisis, travel documentation, background checks, etc. these conditions are for a new seafarer as many of these required certifications are accepted if the candidate is already at sea and the certification has a valid date.
· Any charges to the seafarer as highlighted in the MLC 2006 shall be reimbursed by the shipowner once boarded the vessel, all receipts must be taken onboard i.e for Visas, etc.
· Jobs On Board will support the seafarer ensuring the shipowners meet their obligations to the seafarer highlighted in their seafarers employment agreement and/or CBA agreement.
Intellectual Property
All information incorporated within the Jobs On Board website is owned or licensed by Jobs On Board Ltd. You may retrieve and display the content of the Jobs On Board website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Jobs On Board website without written permission from Jobs On Board Ltd.
Applicable Law
These terms and conditions will be subject to the laws of New Zealand. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement, and you want to take court proceedings, you must do so within New Zealand.
Miscellaneous
You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
If you breach these Terms and Conditions and Jobs On Board Ltd chooses to ignore this, Jobs On Board Ltd will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
Jobs On Board shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
The Jobs On Board website is owned and operated by Jobs On Board Limited.

Relationship of Parties
Nothing in these Terms and Conditions shall create, or be deemed to create, a partnership, the relationship of the principal and Jobs On Board Ltd, or of employer and employee between Jobs On Board Ltd and the candidate.
Third Parties
Nothing in these Terms and Conditions shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any party that is not a party to these Terms and Conditions.
Severance
In the event that one or more of the provisions of these Terms and Conditions is found to be unlawful, invalid, or otherwise unenforceable, that / those provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.
Indemnity
The candidate shall indemnify Jobs On Board Ltd against any costs, liability, damages, loss, claims, or proceedings which may arise out of its use of the services; its submission of any information set out in these Terms and Conditions or any other information; any applications it may submit to any Client; or any breach of any part of these Terms and Conditions.
Liability
Jobs On Board Ltd shall not be liable for any of the following:
· The loss of any data, CV or other materials submitted by the Candidate;
· Any errors or inaccuracies present in the information presented to Candidates including, but not limited to, vacancy advertisements;
· The failure of the Candidate to secure employment with any of its Clients whether caused by the negligence of Jobs On Board Ltd, its employees or agents, or any other cause;
· Any loss or damage of any kind, howsoever caused arising out of the negligence, misconduct, dishonesty, breach of faith, or breach of contract on the part of any Client; and
· Any loss or damage of any kind, howsoever caused arising out of any material submitted to Jobs On Board by the candidate.
· If Jobs On Board is in breach of these Terms and Conditions, we will only be responsible for any losses to the extent that they are a foreseeable consequence to both of us. Our liability shall not in any event include business losses such as lost data, lost profits, or business interruption.
Nothing in these Terms and Conditions shall exclude or otherwise restrict Jobs On Board Ltd's liability for death or personal injury arising out of its own negligence.
